Broncos' Cox Granted More Time In Sex Assault Case - Denver News Story

DENVER -- A judge on Friday granted Denver Broncos cornerback Perrish Cox more time to review a statement he gave to police investigating sex assault allegations against him. Cox faces one count of sexual assault against a victim who was physically helpless and one count of sexual assault against a victim who was incapable of determining the nature of the conduct. Cox has pleaded not guilty and is free on $50,000 bail. Cox appeared in court in Castle Rock on Friday. His attorney, Harvey A. Steinberg, told the judge that he had received a DVD of Cox making a statement to police just hours before the hearing, which was to consider what evidence to allow at trial in October. District Court Judge Paul King rescheduled the hearing for Sept. 16. Prosecutors weren't aware the DVD existed until Wednesday, district attorney spokeswoman Casimir Spencer said. Spencer said police in the Denver suburb of Lone Tree, who investigated the case, told prosecutors they had the DVD. Police said they should have given it to the DA's office sooner, she said. King has allowed Cox to travel outside Colorado for Broncos games, Steinberg said. That request was granted before the Broncos' first preseason game at Dallas on Aug. 11. According to an arrest affidavit, a woman told investigators she had suspicions that she was drugged and possibly raped when she spent a night at Cox's apartment in September. She went to police on Oct. 28, the day she said she learned she was pregnant. Doctors put the date of conception around the time she visited Cox's apartment with friends on Sept. 6. The woman said she could not remember most of that night and wasn't sure anyone had sex with her until she learned she was pregnant. She told investigators that she didn't file a complaint sooner because she wasn't sure she had been raped and didn't want to make unfounded charges. When police interviewed Cox on Nov. 8, he denied having sex with the accuser, the affidavit said. Cox refused to allow a DNA sample to be taken until after investigators obtained a court order, the document said. According to the affidavit, DNA tests show Cox is the father. Cox started nine games as a rookie cornerback last year but has been fighting for snaps with the second- and third-string defense this summer. He blamed his slip down the depth chart on playing nickel cornerback for the first time, lining up inside to face the slot receiver rather than on the outside. Cox was the team's third cornerback last year. This summer, he's played behind star Champ Bailey, starting right cornerback Andre' Goodman, Cassius Vaughn and Nate Jones. The Broncos play their third preseason game on Saturday night against Seattle in Denver.
